Mohammed Khatib الإطار القانوني لملكية الأراضي والتصرف فيها في فلسطينمقدمة:عند الحديث عن موضوع التنظيم القانوني لملكية العقارات فانه يدور في الأذهان مباشرة مدى التعقيد والتشابك والتداخل في موضوع الأراضي والعقارات وملكيتها على ارض الواقع، وهو ما يشغل بال العاملين في هذا القطاع الهام والحيوي بالنسبة للفلسطينيين، إذ أن أساس الصراع كان على الأرض وما زال.وحتى نغطي الأمر من كافة جوانبه كان لزاما علينا أن نقوم بدراسة الواقع القانوني والتنظيمي لمسائل الأراضي والعقارات في كافة الحقب التي مرت على فلسطين وما خلفته من أنظمة قانونية وتشريعات لها علاقة وتمس بشكل مباشر موضوع تملك الأموال غير المنقولة في فلسطين، حيث كان لكل حقبة من هذه الحقب ما يميزها ويطبعها بطابعها العام، ابتداء من الحقبة العثمانية وما خلفته من قوانين تطبق حتى كتابة هذه الورقة مرورا بالانتداب البريطاني وما سنه من قوانين تتعلق بالأراضي وغيرها وما أثارته من إشكاليات عملية على ارض الواقع، وتعريجا على الحقبة الأردنية وما كان لها من الأثر الكبير في موضوع الأراضي، والتي تزامنت مع الإدارة المصرية على قطاع غزة وما خلفته من قوانين، ومن ثم مرحلة الاحتلال الإسرائيلي وما صنعه على الأرض من السيطرة عليها عن طريق ما يسمى بالأوامر العسكرية، وانتهاء بالحقبة الفلسطينية والتي تمثلت بقدوم السلطة الفلسطينية في العام 1994، وما أصدرته من قوانين أو قرارات أو تعليمات بشان الأراضي.أولا: تقسيمات وأحكام الأراضي في فلسطيننظم قانون الأراضي العثماني لسنة 1858 الأحكام المتعلقة بالأراضي وحدد تقسيماتها وفقا للمادة الأولى منه، فقسمها إلى خمسة أنواع متمايزة، وهي:- الأراضي الملك- الأراضي الأميرية- الأراضي الوقف- الأراضي المتروكة- الأراضي المواتأ- الأراضي الملكوقد تم تقسيمها إلى أربعة أنواع وذلك بموجب المادة الثانية منه، وهي:• الأرض الملحقة ببيت السكن والتي لا تزيد مساحتها على نصف الدونم، أي أنها الأرض التي تكون في موقع البناء والتي تعتبر من قبيل الأراضي الملك، كما يتبين أيضا أن الأرض التي تقع خارج حدود البلدية (سواء خارج بلديات المدن أو المجالس القروية) لا يؤثر على نوع الأرض كونها ملحقة ببيت سكن أم لا أو بناء بيت السكن في أرض أميرية، لا يحولها ذلك الواقع من نوع الأميرية إلى الملك، بل إن الأراضي التي تلحق مواقع البناء التي تدخل ضمن حدود البلديات فقط هي التي تعتبر من نوع الملك.• الأراضي التي أفرزت من الأراضي الأميرية وملكت تمليكا صحيحا بأسماء مالكيها.• الأراضي العشرية: التي وزعت وملكت للفاتحين عند الفتح.• الأراضي الخراجية: التي تقرر إبقاءها في يد أهلها غير المسلمين على أن يدفعوا عنها مبلغا من المال للدولة.- أحكام الأراضي الملك:صاحب الأراضي الملك مالك للأرض نفسها، وفي الوقت ذاته مالك لما تحتها وما فوقها له كامل الحرية في التصرف فيه، يحق له أن يتصرف فيه بكافة أنواع التصرفات العقارية سواء الناقلة لملكية رقبتها أو غير الناقلة كالهبة والرهن وغيرها، وهذا ما أكدته مجلة الأحكام العدلية في نصوصها الواردة في الباب الثالث منها. وتجدر الإشارة إلى أن عبارة الأرض وما فوقها تشمل الأرض وما عليها من بناء أو غيره.ب- الأراضي الأميريةهي الأراضي التي تكون رقبتها لبيت المال ويجري إحالتها و تفويضها لأحد من قبل ولي الأمر بناء على طلبه لمدة غير محددة، لقاء معجلة تسمى الطابو يدفعها الطالب للخزينة ويعطى سند رسمي بذلك.- أحكام الأراضي الأميرية:أن المتصرف بأرض أميرية له أن ينتفع بها على الوجه الذي يريد، إلا أنه إذا أراد البناء في الأرض أو إذا أراد فراغها إلى آخر عليه الحصول على إذن من إدارة الطابو، كذلك إذا تركت الأرض دون استعمال لمدة أكثر من ثلاث سنوات بلا عذر فإنها تنحل عنه.- التصرفات الجائزة على الأراضي الأميرية:قسم قانون الأراضي العثماني التصرفات الواردة والجائزة على الأراضي الأميرية إلى ثلاثة أنواع، وهي:- تصرفات مطلقة للمتصرف كالزراعة، والرهن والانتفاع بحشائشها .- تصرفات لا تتم إلا بإذن المأمور وهي فراغ الأرض أي بيعها وهبتها وقسمتها وغرس الأشجار وقلعها وإنشاء الأبنية.- تصرفات محظورة مثل وقف الأراضي الأميرية.ومما تجدر الإشارة إليه في هذا السياق أن هذا النوع من الأراضي قد طرأت عليه تعديلات جذرية، حيث صدر قانون تحويل الأراضي من نوع الميري إلى ملك رقم( 41) لسنة 1953 ، على النحو الآتي:1- أعطى هذا القانون الحق لكل من يمتلك ارض ميرية تحويلها إلى ملك بقصد وقفها لجهة خيرية، وذلك وفق الإجراءات التالية:أ- استصدار قرار من مجلس الوزراء بتمليكه هذه الأرض تمليكا صحيحا، وتحويلها من ميري إلى ملك.ب- يأمر المجلس بنشر القرار بالجريدة الرسمية بتمليكه الأرض، إذا اقتنع أن هناك مسوغات قانونية.ت- يجب تنفيذ هذا القرار خلال ستة أشهر في دائرة التسجيل من تاريخ صدوره وإلا اعتبر لاغيا.2- أعطى هذا القانون الحق بتحويل الأراضي الميري الواقعة داخل حدود البلديات من ميري إلى ملك، إذا قامت البلدية بتوسيع حدودها فتلقائيا تصبح هذه الأراضي من نوع الملك من تاريخ التوسع.3- وفيما يتعلق بآلية انتقال الأراضي الأميرية إلى الورثة بموجب هذا القانون فقد أشار القانون إلى عدد من الحالات وهي على النحو الآتي:- آلية انتقال الأراضي:أ. الحالة الأولى:إذا كان صاحب أرض أميرية وتوفي قبل العمل بهذا القانون:هنا تنتقل الأرض إلى الورثة وفقا لقانون انتقال الأراضي الأميرية باعتبارها أرضا أميرية (أي تقسم بالتساوي (للذكر مثل الأنثى) وليس حسب تقسيم الشريعة) وتسجل بأسماء الورثة على اعتبار أنها ملكا ولكن بشروط:1- إذا تم انتقالها وتسجيلها خلال سنة واحدة من تاريخ العمل بهذا القانون2- أو في خلال سنة واحدة من تاريخ نفاذه إذا كانت الأراضي الأميرية محولة إلى ملك وذلك وفقا لما ذكرناه في الفقرة( 1، 2) أعلاه.3- وفي حال لم يتم الانتقال خلال المدة المذكورة فتسجل الأرض على أنها ملكا.ب. الحالة الثانية:وأشار لها القانون المؤقت المعدل لقانون تحويل الأراضي من نوع الميري إلى ملك رقم 32 لسنة 1962 جاء التعديل على المادة 4 من القانون رقم 41 لسنة 1953 بإضافة فقرة جديدة للمادة 4 وهي على النحو الآتي:أ- حيث أشارت هذه الفقرة على انه بالرغم مما ورد في الحالة الأولى والتي اشرنا لها سابقا، إلا انه لا تنطبق أحكام الفريضة الشرعية على أصحاب حق الانتقال والتصرف في الأراضي الأميرية التي لم تتم تسويتها سواء كانت مسجلة أو غير مسجلة في حال حصلت الوفاة قبل العمل بهذا القانون، حيث يتم توزيعها حسب المسالة القانونية (أي للذكر مثل الأنثى) وتسجل على أنها ملك، على انه يستثنى من ذلك أية ارض أميرية لم تتم |
